OBPAI Terms of Service

Welcome to OBPAI ("we", "us", "our", or the "Service"). OBPAI is operated by the OBPAI team and encompasses both the website (obpai.com) and the OBPAI iOS application.

By accessing or using our website, downloading, installing, or using our iOS mobile app, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not access or use our services.

If you are using the Service on behalf of an entity or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

OBPAI provides an all-in-one tier list ranking, decision-making, and bracket tournament platform. Key features include:

• Interactive drag-and-drop Tier List Maker with custom tier colors and labels;

• 1v1 Bracket Tournament elimination PK and win-rate leaderboards;

• Lucky Wheel random picker and decision tool;

• AI-assisted automatic tier list generation;

• Template browsing, search, favorites, local storage, and cloud sync;

• Watermark-free HD WebP / PNG image export for creators and social media sharing.

We reserve the right to modify, enhance, suspend, or discontinue any feature or aspect of the Service at any time.

You may use certain features anonymously or register an account to unlock cloud saves, profile customization, and premium features.

When creating an account, you agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

If you suspect unauthorized access to your account, please notify us immediately at support@obpai.com. We reserve the right to suspend or terminate accounts that engage in fraudulent or abusive activities.

OBPAI allows users to upload images, create custom tier lists, organize rankings, and share results (collectively, "User-Generated Content").

You retain all ownership rights in your User Content. By submitting content to the Service, you grant OBPAI a worldwide, non-exclusive, royalty-free license to host, store, cache, display, format, and reproduce such content solely for the purpose of operating and improving the Service.

You represent and warrant that your content does not violate any applicable law or infringe any third-party rights. You agree not to upload or share content that:

• Is unlawful, defamatory, libelous, obscene, sexually explicit, or harassing;

• Promotes hate speech, violence, discrimination, or illegal acts;

• Infringes any copyright, trademark, patent, trade secret, or privacy right;

• Contains computer viruses, malicious scripts, or harmful code;

• Involves unauthorized automated scraping, spamming, or tampering with rankings.

OBPAI reserves the right (but assumes no obligation) to review, moderate, remove objectionable content, and suspend or terminate non-compliant accounts.

OBPAI may offer optional premium VIP memberships or one-time digital purchases.

• Web Purchases: Processed securely through third-party payment gateways such as Stripe. Pricing, billing frequency, and features are clearly displayed at checkout.

• iOS In-App Purchases: Purchases made within the iOS application are processed via Apple App Store StoreKit and are governed by Apple Media Services Terms and Conditions.

• Auto-Renewal & Cancellation: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing cycle. You can manage or cancel your iOS subscription anytime in your iOS Settings → [Apple ID] → Subscriptions.

• Refund Policy: Unless required by applicable law, payments are non-refundable. For purchases made through Apple In-App Purchase, refund requests must be submitted directly to Apple according to Apple’s refund policies.

For users downloading the OBPAI iOS application from the Apple App Store, the following terms apply in conjunction with the standard Apple EULA:

• Scope of License: You are granted a non-transferable, non-exclusive license to use the app on any Apple-branded products that you own or control.

• Maintenance and Support: OBPAI is solely responsible for providing any maintenance and support services. Apple has no obligation whatsoever to furnish any maintenance or support services.

• Warranty and Product Claims: OBPAI, not Apple, is responsible for addressing any claims relating to the application, including product liability claims, consumer protection claims, and intellectual property claims.

• Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

The OBPAI name, logo, website designs, user interface, software code, and proprietary algorithms are owned by OBPAI and protected by intellectual property laws.

All third-party trademarks, entity names, character images, and logos referenced within community tier list templates are the property of their respective owners and are used strictly for identification, commentary, and categorization purposes.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OBPAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

You may request the deletion of your account and personal data at any time through your account settings or by emailing support@obpai.com.

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without prior notice, if you breach these Terms.

These Terms shall be governed by and construed in accordance with applicable laws, without giving effect to any principles of conflicts of law.

Any dispute arising from or relating to these Terms shall be resolved through amicable negotiations, or failing that, through competent courts in our operational jurisdiction.
